Where an objection decision has not been served within the time specified (The Commissioner shall serve notice of an objection decision on a person objecting within ninety days from the date of receipt of the objection), the person objecting may by notice in writing to the commissioner, elect to treat the Commissioner as having made a decision to allow the objection.
